Payments when laying off a civil servant in 2020
In cases not provided for by Law No. 79-FZ, the Labor Code of the Russian Federation should formally be applied. But in the matter of calculating payments to civil servants during staff reductions, this is not necessary: the specified federal law fully regulates such payments. Let us note that in many respects they are accrued according to principles similar to those reflected in Articles 178, 180 and other articles of the Labor Code of the Russian Federation, which regulate payments for staff reductions in ordinary organizations.
If within 2 months an alternative job has not been found for the dismissed person, then the contract for performing public service with him is terminated. A person is required to pay compensation in the amount of salary for 4 months (clause 3.1 of Article 37 of Law No. 79-FZ). Please note that this is not severance pay provided for by the Labor Code of the Russian Federation - severance pay is not paid to civil servants. The salary of federal civil servants is calculated according to the rules approved by Decree of the Government of the Russian Federation dated September 6, 2007 No. 562 (as amended on July 10, 2014).
Payments upon Retrenchment of a Civil Servant Due to Unemployment
Note that this period applies when the employee was not employed during the second or third month, as well as in the case of proportional retention of earnings. The new edition of Article 178 of the Labor Code of the Russian Federation does not specify how to count the month from the date of dismissal. In accordance with Part 3 of Art. 14 of the Labor Code of the Russian Federation, terms calculated in months expire on the corresponding date of the last month of the term. It is important to remember that if the last day of the period falls on a non-working day, then the end of the period is considered to be the next working day following it.

The fact is that an organization in the process of liquidation can be deregistered before the second or third month for employing the dismissed employee has expired. However, the person responsible for payments is not always appointed. From 08/13/2020 this problem will no longer exist.
The maximum permissible payment period is approved by law and cannot exceed a total of 12 consecutive months over a period of 15 calendar months. However, the accrual of benefits can be extended for another year if the citizen was unable to find work for objective reasons (for example, due to the lack of vacancies at the employment center).
If the job search is delayed, the citizen will be able to partially retain payments. To do this, he must contact the local employment center and officially register as unemployed. If for compensation for the first two months you do not need to confirm the specified status, then for payment in the third month you cannot do without registration. The labor exchange will issue an order to the former employer only if the citizen complies with all conditions for unemployment.
