Maternity payments in 2021

The Social Insurance Fund is obliged to accrue benefits no later than 10 calendar days from the moment the Fund received from the employer the information necessary for the calculation and payment of benefits.

Payments for pregnant women are established by the federal law “On state benefits for citizens with children” dated May 19, 1995 N 81-FZ.

Who is eligible to receive maternity benefits in 2021?

The following categories of women have the right to receive maternity benefits:

Maternity benefits are paid for the period of maternity leave, the duration of which is 70 (84 for multiple pregnancies) calendar days before the birth and 70 (86 calendar days for complicated births or for the birth of two or more children) calendar days after the birth .

In case of adoption of a child

When adopting a child (children) under the age of three months, maternity benefits are paid for the period from the date of adoption until the expiration of seventy calendar days (in the case of simultaneous adoption of two or more children - one hundred and ten calendar days) from the date of birth of the child (children). ).

Officially unemployed people dismissed from liquidated enterprises submit to the district social security department a copy of their passport, a ballot, a notarized copy of the work book and written confirmation from the employment department about registration as unemployed.

The specified application and copies of documents certified by a notary can be sent by mail, as well as in electronic form. An authorized person authorized to represent the pregnant woman in the authorities in the presence of a notary has the right to transfer documentation for maternity leave.

After providing sick leave for pregnancy and an application to working women, students, military personnel, employees and individual entrepreneurs, payments are accrued no later than 10 calendar days.

Transfer of benefits to officially unemployed persons occurs before the 26th day of the following month after registration of the submitted documents.

But there is also an exception when such benefits are not paid. Such benefits cannot be paid if the woman gave birth to a stillborn child.

What is the amount of this benefit?

A one-time benefit for the birth of a child is paid in the amount of 8,000 rubles.

Average daily earnings, determined based on salary data for the previous two years, should not be lower than average daily earnings, determined based on the minimum wage. The minimum average daily earnings will be needed if the woman did not have a salary in the accounting years or her earnings for the full month turned out to be below the minimum wage.

Average daily earnings 2020min = minimum wage 2020 × 24 / 730.

Having calculated this expression, we find that the minimum average daily earnings for the BiR benefit in 2021 is equal to 398.79 rubles.

In 2021, taking into account the new minimum wage (RUB 12,792), the formula will be as follows:

Average daily earnings 2021min = minimum wage 2021 × 24 / 730.

This means that the average earnings in 2021 will be 420.56 rubles.

Thus, for a vacation lasting 140 calendar days, the minimum benefit is:

  • in 2021 will be 55,830.60 rubles;
  • in 2021 - RUB 58,878.40.

If the vacation lasts 156 days:

  • the minimum for 2021 will be at RUB 62,211.24,
  • 2021 - 65,607.36 rubles.

If the vacation duration is 194 days:

  • the minimum for 2021 is 77,365.26 rubles,
  • 2021 - RUB 81,588.64.

Calculation of maternity payments for other citizens

Women, employees of the military, customs, fire-fighting services, internal affairs bodies and other federal bodies receive maternity leave benefits in the amount of the average salary for the previous 12 months that precede the month of the insured event.

Full-time male and female students of vocational educational institutions are awarded a pregnancy sick leave benefit in the amount of the scholarship received. If a student is studying in the commercial department or does not receive a scholarship due to poor academic performance, then payments will be based on the standard scholarship.

Maternity benefits will also be received by unemployed women registered with the employment center who, within 12 months before receiving sick leave for pregnancy and childbirth:

  • stopped individual entrepreneurship;
  • have lost their status as a lawyer, notary or other position whose professional activities are subject to licensing.

In 2021, these categories of women are assigned maternity compensation - 613.14 rubles for each month of leave. For a natural birth without complications (140 days), this amount will be 2,861.60 rubles.
