Production factors on the basis of which workwear is issued

The employer issues protective clothing to its employees within the limits approved by it. An order on the standards for issuing workwear is drawn up based on the results of a special assessment of working conditions, while the standards for issuing workwear cannot be lower than those provided for by law (Letter of the Ministry of Labor dated September 30.

2016 No. 15-2/OOG-3519, clause 5 of the Rules, approved. Order of the Ministry of Health and Social Development dated June 1, 2009 No. 290n). For example, standard standards for the free issuance of special clothing for all sectors of the economy were approved by Order of the Ministry of Labor dated December 9, 2014 No. 997n, and for the fishing industry - by Order of the Ministry of Labor dated December 29, 1997 No. 68.

The employer must ensure accounting and control over the issuance of special clothing to employees. However, the law does not require drawing up an order for the issuance of protective clothing. Accounting for the issuance of protective clothing to employees and their return are recorded in the personal record card for the issuance of personal protective equipment (clause 13 of the Rules, approved by Order of the Ministry of Health and Social Development dated 06/01/2009 No. 290n).

At the same time, depending on the scale of the organization and the specifics of its activities, as well as the features of control over the movement of workwear, the employer can additionally draw up an order for the issuance of personal protective equipment.

Here are the main production factors on the basis of which workwear is issued:

  • harmful - these are chemical and biological factors that negatively affect the human body (dust in the workplace, air containing a huge amount of hazardous substances that a person inhales, infrared rays, ultraviolet radiation, etc.);
  • dangerous ones are acoustic, ultrasonic, electrical and vibration factors, i.e. These are conditions that can injure an employee. For example, a machine has open moving parts and, due to the technical process conditions, it is impossible to protect them with a rigid body.

If an employer has doubts about what kind of workwear to issue to his employees, he can always look at the certification card (a document that displays all the data on working conditions at the enterprise).

How to organize washing and cleaning of PPE

This is also stated in paragraph 64 of Section VII of the Guidelines for accounting of special tools, special devices, special equipment and special clothing, approved by Order of the Ministry of Finance dated December 26, 2002 No. 135n: “Working clothing issued to employees is the property of the organization and is subject to return upon dismissal "

clause 11 of the Intersectoral Rules approved by Order of the Ministry of Health and Social Development dated 06/01/2009 No. 290n

Security guards have the right to wear uniforms. There are no current requirements for issuing protective clothing to them. If, based on the results of the fire safety assessment, harmful working conditions are determined at the security guards’ workplaces, then PPE must be issued. Also, PPE must be issued if security guards work in special temperature conditions and in jobs that involve pollution (paragraph 6, part 2, article 212, article 221 of the Labor Code).

An order to issue special clothing is an official order from the director of the company, which must be drawn up in writing. The document implies the issuance of specially designed clothing, shoes and other personal protective equipment to personnel in the event that their work is associated with production factors harmful to health.

If there are harmful and dangerous production factors in the workplace at an enterprise, the employer is obliged to provide workers with personal protective equipment. In this article we will tell you how to issue an order for the issuance of PPE and provide a sample of it.

The process of providing workers with personal protective equipment is carefully regulated by the current legislation of the Russian Federation, which means that it is necessary to follow a certain issuance procedure. If during the visit of the GIT inspector even the slightest violation of this procedure is revealed, sanctions may follow.

It is important to correctly prepare an order to provide workers with personal protective equipment, an appendix to it, appoint someone responsible for the provision, and also monitor execution.

Let us remind you that special clothing and other equipment must be issued to workers based on the specifics of their working conditions, the presence of harmful and hazardous production factors (HAPF) in the workplace, as well as in accordance with gender, age, clothing and shoe sizes. For example, if working conditions require a high background noise, then PPE for the hearing organs (special headphones, helmets) should be provided, and if the air is polluted with gases or dust - for the respiratory organs (PPE, gas masks, respirators).

We have prepared for you the most common form that can be used as a sample. Below we will discuss in detail who and how should develop this document, as well as the appendix to it.

“Working clothing” means clothing, shoes, hats, gloves, mittens and various devices that are issued for individual use and help protect workers of enterprises and organizations from the effects of harmful, dangerous and aggressive factors, including fire, environmental, radiation, electrical etc.

In particular, workwear can be called the standard official uniform of employees, which is intended to demonstrate their affiliation with a particular company. In such cases, workwear is usually used in direct contact with consumers of products or services - for example, sellers, managers and other similar categories of personnel.

For all sectors of activity, there are established standards for the issuance of PPE, which employers should adhere to.

They contain not only lists of personal protective equipment, but also the timing for which they should be provided to employees. The director of an enterprise, taking into account its specifics, can develop his own issuance standards, but without compromising the existing ones.

If for some reason an employee refuses to wear a uniform, this fact should be documented to relieve the employer of liability. Since for failure to provide a worker with special clothing, he may face a serious fine. It is prohibited to allow a person who has neglected safety rules to work.

Since initially the head of the enterprise is responsible for labor protection at the enterprise, therefore, he can prepare this document independently.

In practice, such powers are usually delegated to a labor protection specialist.

He develops a draft order in accordance with the procedure for issuing protective equipment, the requirements of legislation and internal regulations, after which he submits it to the manager for signature.

Please note: in the Tax Code itself and especially in various relevant laws and regulations, the conclusion of a collective agreement is often mentioned as one of the mandatory conditions for including expenses in the cost of expenses. Let's consider this point in more detail.

According to Article 221 of the Labor Code of the Russian Federation, in industries with harmful or dangerous working conditions, as well as in work performed in special temperature conditions or associated with pollution, workers are provided with special clothing, special shoes and other personal protective equipment free of charge. Personal protective equipment, flushing and disinfecting agents, inter-industry rules for issuing special clothing and special footwear, read here) these are workwear, special footwear, respiratory, vision, touch (skin) protection.

Based on paragraph 7 of the intersectoral rules, the employer has the right, taking into account the opinion of the representative body of trade unions authorized by the employees, to replace one type of workwear provided for by the standard standards, similar, but providing equivalent protection from dangerous and harmful production factors. For example, the service life of felt boots for the first belt will be 4 years, for the special fifth one - 2 years.

The issuance of special clothing, special shoes and other personal protective equipment is carried out using a personal card for recording the issuance of personal protective equipment. Order of the Ministry of Health and Social Development of Russia dated 1247n as amended by the year. In accordance with the order of the Russian Ministry of Labor dated 997n, it is allowed to issue double norms at the same time.

The procedures and procedure for issuing protective clothing and protective equipment are regulated by the Order of the Ministry of Health and Social Development of the Russian Federation. The State Committee of Ukraine for Industrial Safety will help determine the circle of persons and scope of application; labor protection and mining supervision Order, Norms dated 04/16/2009

Issuance procedure

Based on the SOUT protocol and standards, the enterprise determines its own

list of special clothing needs.

A personal card is created for each employee included in such a list. PPE is issued taking into account the gender, height, and size of the employee. They provide protective items, clothing and shoes against signature. At the end of the period of use, a write-off note is made. If the card is maintained electronically, then it must still contain a link to the register or document in which the employee personally signed for the workwear received.

One of the latest additions to the rules for the provision of PPE allows for their issuance through vending equipment, automatically.

If the wear period has not expired and the employee quits, it is possible to return it to the warehouse or reimburse the employee for the residual value determined by the wear period of the item. The period of use is calculated from the date of transfer to the employee.

The enterprise, at its own expense, is obliged to take care of personal protective equipment (washing, cleaning, drying, repairs, degassing, disinfection). This norm is contained in Article 221 of the Labor Code of the Russian Federation.

To ensure timely care of PPE, it is permissible to issue two sets, increasing their service life to the total.

When hired, an employee must be familiar with the composition and timing of replacement of personal protective equipment for his profession and work schedule.

According to the Rules set out in Order No. 290n dated 06/01/2009, PPE that has passed the mandatory certification procedure is used. If an enterprise expects to receive reimbursement from the Social Insurance Fund for expenses on workwear (Order No. 580n dated December 10, 2012 “On financial support”), the product must be manufactured in Russia and from Russian materials.

For persons visiting areas with harmful (dangerous) working conditions, the employer provides on-duty PPE (for example, when delegations or management visit production shops, “on-duty” gowns and helmets are issued). For workers performing work in related professions on a part-time basis, PPE is issued for each of the professions (for example, a mechanic working part-time as a welder will receive two sets of PPE).

We draw up an order for the issuance of special clothing

If the employer decides to issue an order for the issuance of special clothing, it can be drawn up in any form. It indicates the list of persons to whom special clothing is issued, as well as its list. In this case, the list of persons and the list of issued special clothing may not be provided in the order if they are appendices to the order. The order also usually indicates the details of the employer’s organizational and administrative document, which approves the standards for issuing workwear.

There is no need to obtain the signature of the persons to whom the protective clothing is issued regarding familiarization with the order. After all, the order is rather a guide to action for the person responsible for issuing special clothing. And the employee who actually received it will still have to put his signature on the personal card for recording the issuance of personal protective equipment. The order should be signed only by the person who will issue the personal protective equipment.

For an order for the issuance of protective clothing in an organization, we will provide a sample of how to fill it out.

So, in an organization, the issuance of specially designed clothing, shoes and other protective equipment is, firstly, the prevention and reduction of the negative impact on the body of working personnel, the main place of which is the production environment, which has harmful or dangerous factors for the human body, and secondly secondly, it provides excellent protection against special temperature conditions and various types of contaminants.

Also, all employees and officials mentioned in it must put their signatures on the familiarization sheet.

The document must initially be prepared based on the specific conditions of existing workplaces. This means that it cannot be compiled by simply introducing standard norms into it - it can only be based on them. An important part - the application - must contain a complete list of PPE required by law for each profession represented at the enterprise.

As often happens, a single exact form has not been approved. The document must contain:

  • name of company;
  • date of preparation and order number;
  • Full name, position of the manager approving the document.

The order must appoint someone responsible for providing workers with protective equipment and specify his responsibilities:

  • issuing personal protective equipment to employees;
  • monitoring compliance with the service life of products;
  • ensuring their storage and timely maintenance;
  • keeping a log book;
  • control over returns in accordance with the procedure established by law (expiration of service life, dismissal of an employee or change of workplace, etc.)

Working in hazardous or hazardous conditions is considered very risky for employees, so the employer must ensure that they are provided with certain benefits and compensation for this. In particular, one of the types of such compensation is the free provision of special clothing and shoes.

The presence of this document in the company where the workwear is to be issued is a mandatory requirement. Since it will contain all the necessary data regarding the rules and conditions for its provision, all employees during employment should be familiar with it.

Order on the Appointment of Persons Responsible for Accounting and Issuing PPE 2021

HR records management is a complex and multifunctional process, which is regulated by the legislation of the Russian Federation and requires proper documentation. Therefore, it is very important that this process is handled by a full-time HR specialist who has the relevant experience. However, there are cases when an organization does not have a full-time personnel officer and accountants, secretaries, and office managers are involved in preparing personnel documents. In a small organization, the functions of preparing personnel documents can be performed by the manager himself - in this case, additional documentation is not required, since in accordance with the organization’s charter, the manager is responsible for any aspect of the organization’s activities.

This order comes into force from the date of its signing by the director of the Company. Control over the implementation of this order is entrusted to the deputy director. Last name First name Patronymic. All rights reserved. We accept for payment:.

Important: Do not forget that PPE may also include flushing agents, neutralizing agents and other liquids. There are complex types of protection: overalls of various configurations and purposes.

A complete list of protective equipment at work can be found in GOST 12.4.011-89.

How to issue The Labor Code does not regulate exactly how and within what time frame it is necessary to issue personal protective equipment.

The head of the organization or the employee responsible for this has the right to independently decide the form and frequency of issuance. If workers are provided with protective equipment constantly and of adequate quality, then the inspection organizations will not have any complaints.

As for the legislative framework, the process of issuing PPE is regulated by Order of the Ministry of Health and Social Development No. 290n dated June 1, 2009. It says that when issuing, one must be guided by the specific specifics of production processes.

How is the accounting of workwear and personal protective equipment organized at an enterprise?

Although the availability and accounting of PPE is not the main goal of enterprises and organizations, it should be carefully maintained. Any inspection by government inspectors may test this issue.

If there is no efficiency when taking into account PPE, RPE and workwear, then the following questions may arise:

  • over time, unaccounted for reserves may be unclaimed in the future, since some RPE may lose their operational properties;
  • the required dimensions are not taken into account when purchasing, which ultimately leads to a shortage of the required dimensions;
  • there is no accounting for used workwear and its delivery to the warehouse; no use in accordance with standard issuance standards;
  • there is no way to clearly monitor the use of PPE by workers.

These problems are automatically assigned to the occupational safety specialist.

Thus, the most effective tool for accounting for special clothing is special software developed specifically for your enterprise.

Responsibility for lack of PPE

The absence of PPE required by law or violation of the standards for ensuring and operating procedures for products is a serious violation that will lead to administrative liability for the employer. According to Part 4 of Art. 5.27.1 of the Code of Administrative Offenses of the Russian Federation, a fine may be imposed for this:

* for officials – from 20,000 to 30,000 rubles; * for individual entrepreneurs – from 20,000 to 30,000 rubles; * for legal entities – from 130,000 to 150,000 rubles.

If the employer has previously been prosecuted for violating the standards for providing personal protective equipment, more serious sanctions may be imposed on him:

* for officials – a fine from 30,000 to 40,000 rubles. or disqualification from one to 3 years; * for individual entrepreneurs – a fine from 30,000 to 40,000 rubles. or suspension of activities for up to 90 days; * for legal entities – a fine from 100,000 to 200,000 rubles. or suspension of activities for up to 90 days.

Who is developing the order?

As you know, the director is responsible for the system of preserving the life and health of workers during their work at the enterprise, which means that he can prepare an order for the issuance of special clothing himself. But, as practice shows, he appoints a person responsible for labor protection, who must develop a draft document in accordance with the requirements of Russian legislation. Next, he submits the finished document to the director for signature.

In addition to the director’s signature, the document must contain the signatures of all employees appearing in it.

We invite you to familiarize yourself with: Business inheritance: an enterprise as a property complex and cooperative rights, LLC and OJSC, individual entrepreneur rights

What data is considered personal?

Together with the order to allocate protective clothing to the company, a list of working personnel is created indicating the sizes of protective clothing to be issued. Next, the procedure for purchasing and issuing protective clothing is carried out according to the following algorithm.

  1. An application for workwear in appropriate sizes is submitted to trade enterprises.
  2. After payment, the received goods are transferred to the warehouse.
  3. The issuance of PPE to the employees of the enterprise is carried out according to a statement signed either by the director or the safety engineer.
  4. This statement shows:
  • Serial number.
  • Full name, employee.
  • The position he holds.
  • Name of PPE.
  • Size and quantity.
  • The employee’s signature when receiving PPE.

The question often arises: is the data entered in the statement on the issuance of personal protective equipment personal and not subject to disclosure?

According to the legislation of the Russian Federation, personal data can be divided into 4 categories:

  • Information about race and nationality, about the personal life of an individual, about his health, about philosophical, religious and political inclinations.
  • FULL NAME. citizen, location address, salary data, passport details, INN and SNILS number.
  • Data containing full name and date of birth.
  • Publicly available data that cannot be used to identify a specific individual.

Based on the above, the information displayed in the order for the issuance of protective clothing along with the attached statement belongs to the last category of personal data that is publicly available.

How to eliminate mistakes that were made when drawing up a document

It happens that when drawing up a document, a specialist makes mistakes. Here are the most basic ones:

  • the name of the organization is written incorrectly;
  • the date, month or year are written incorrectly or not written at all;
  • registration number is not indicated;
  • the part of the structural unit that needs to be provided with special clothing is not indicated;
  • positions are not indicated in the introduction column;
  • Various amendments have been made;
  • the main text is written in handwriting that is very difficult to read;
  • Employees' names are written incorrectly;
  • there are a lot of spelling errors in the text;
  • The text has been heavily erased.

Procedure for dismissal of a personnel inspector

Standards for issuing workwear 2021 by profession

What kind of personal protective equipment should be issued to employees working in hazardous conditions, in what quantity and for how long, is determined by the “Model standards for the free issuance of special clothing, special footwear and other personal protective equipment to employees classified by type of economic activity,” approved. By Order of the Ministry of Labor dated December 9, 2014 No. 997n.

The presence of the first clause on the issuance of protective clothing for workers in cross-cutting professions may cause some misunderstanding as to what specific standards for issuing PPE should be followed in cases where the worker’s profession is indicated both in the general and in the sectoral lists.

According to Article 209 of the Labor Code of the Russian Federation, special clothing, shoes and personal protective equipment are means for individual use by citizens to protect against adverse production factors and pollution. Currently, the Order of the Ministry of Labor dated December 9, 2014 No. 997n is in force, which approves the “Standard standards for the free issuance of special clothing, special footwear and other personal protective equipment to employees of cross-cutting professions and positions of all types of economic activities engaged in work with harmful and (or) dangerous working conditions, as well as work performed in special temperature conditions or associated with pollution.”

It is this document that defines the procedure for fulfilling the obligation of employers to provide employees with special clothing and footwear, as well as personal protective equipment. Such requirements are enshrined in Article 221 of the Labor Code of the Russian Federation in relation to all workers of certain professions engaged in work with hazardous working conditions, as well as in dirty work.

For each profession that requires clothing from the employer, and there are 195 of them in the document, individual standards and completeness are provided. For example, a mechanic needs to be given for a year:

  • rubber boots with protective toe caps - 1 pair;
  • gloves with polymer coating - 12 pairs;
  • suit for protection against general industrial pollution and mechanical impacts - 1 pc.;
  • safety glasses - until worn out;
  • personal protective equipment for respiratory organs, filtering or insulating - until worn out.

It is noteworthy that there are standards even for those professions whose work cannot be called dangerous. Thus, a librarian is entitled to one suit to protect against general industrial pollution and mechanical impacts, which the employer can replace with a robe.

It should be remembered that all established standards for the issuance of workwear and PPE are also influenced by various additional factors. For example, if workers work outdoors in the summer or spring, they should be provided with protection from blood-sucking insects, including suits and repellents. When working in winter, the organization must provide warm clothes and shoes, and when working in high-noise conditions, earplugs. When working at height, special safety devices and helmets are required. All these requirements can be found in the appendices to order No. 997n.

If work activity negatively affects the health of workers, then they are supposed to be provided with protective equipment.

Overalls are provided free of charge in the required quantity. What are the standards for issuing PPE in Russia in 2021?
