It is mandatory that heads of commercial and government agencies monitor the following health problems among drivers that prevent them from driving commercial vehicles:

  • headache;
  • high or low blood pressure;
  • heat;
  • state of alcoholic intoxication;
  • pain in the heart area, etc.

Any of the above conditions can cause an accident, resulting in serious injury (or death) to people and damage to company property. To prevent dire consequences, business entities must conduct systematic medical examinations of drivers and reflect their results in the appropriate accounting registers.

Regular pre-trip inspection is carried out as follows:

  1. The paramedic visually examines the driver. Attention is paid to his gait, behavior, appearance, and connectedness of speech.
  2. A survey is conducted about your well-being.
  3. The health worker examines the skin and mucous membranes for ulcerations, injection marks, and allergic reactions.
  4. The condition of the pupils must be assessed, whether they are constricted or dilated.
  5. Blood pressure and pulse are measured.
  6. Signs of alcohol or drug intoxication are determined.
  7. Various rapid tests can be performed on site.

Based on the results of the examination, the medical worker makes his opinion on the driver’s ability to carry out the trip. He makes an appropriate entry about this in the journal or puts a stamp, the imprint of which contains the phrase “passed pre-trip inspection.” In the case when a medical worker releases a driver on a flight, he draws up a protocol that reflects the reason for the ban on driving a vehicle.

How is the pre-trip medical examination carried out?

During the medical examination they check:

  1. Driver's well-being. The doctor measures basic indicators: blood pressure, pulse, temperature. If the pulse and blood pressure are not normal, these indicators can be measured again after 20 minutes.
  2. Sobriety. The presence of ppm is checked with a breathalyzer.

If the driver has any complaints, vital signs are not normal, or the disease has worsened, he is suspended from work that day. The health worker issues a referral for additional examination to the hospital.

If the breathalyzer detects ppm, or there is a suspicion that the driver has taken drugs, the health worker prohibits going to work.

By law, the inspection is included in working hours. If the employee completes it in his free time, he is paid overtime. The employer also pays for the examination itself.

Content requirements

Commercial organizations and individual entrepreneurs must adhere to the regulations provided for by Order No. 835n. This legal act specifies that all business entities must record the results of driver examinations in pre-trip logs.

The following information must be reflected about each employee who is entrusted with driving a vehicle:

  • FULL NAME;
  • date of inspection and exact time;
  • floor;
  • Date of Birth;
  • examination results;
  • medical report;
  • signature of the responsible person;
  • signature of the driver who passed the inspection.

There is a unified form of this accounting register, approved by the appendix to the Order of the Ministry of Health No. 555 of 09.09.1989. Federal legislation allows business entities to independently develop forms of pre-trip control logs and record them in accounting policies.

In this case, the accounting register must contain all required columns and sections. It is also possible to maintain a journal in electronic form, but in this case it must be possible to print out its pages, and such a register must be endorsed using an electronic digital signature.

The medical worker must regularly report all the results of the pre-trip examination of drivers to management. The situation related to the removal of drivers from performing professional duties should be analyzed monthly.

If the driver systematically commits violations of the regime, such as drinking alcohol, or his health condition does not allow him to make the trip on time, then management must decide to replace personnel.

Who conducts the pre-trip medical examination?

A medical institution (hospital, private medical center) or a medical professional with a special license. Some companies obtain a license and organize inspections themselves.

A driver's access to driving a vehicle is prohibited in the following cases:

  1. Confirmed alcohol or drug intoxication, regardless of stage. If the driver is allowed to perform professional duties in this condition, the person responsible for the medical examination and the management of the organization will be held administratively liable. In the event that a driver in such a state commits an accident, his actions will fall under the regulations of the Criminal Code. In this case, criminal liability may threaten all persons responsible for his admission to work.
  2. Persons who are ill are prohibited from driving commercial vehicles, regardless of whether it is a high fever or a more serious illness.
  3. It is strictly forbidden to allow drivers on the route who have surges in blood pressure (also low or high) or heart pain. In this condition, he may become ill while driving and lose control of the car.
  4. It is prohibited to drive commercial vehicles in a state of increased nervousness, after suffering stress, with an unstable psycho-emotional background, with increased aggression, etc.

It is worth noting that if the driver is released on a flight without undergoing a medical examination, then an administrative report will be drawn up against the guilty person, according to which he will have to pay penalties in the amount of:

  1. Individual entrepreneurs: 15,000-100,000 rubles. For a repeated offense, the fine increases to 40,000 rubles.
  2. Legal entities: 110,000-130,000 rub. For a repeated offense, the fine increases to 200,000 rubles. The activities of a commercial organization may be suspended for 90 days.
  3. Officials: 2000-20000 rub.

Fines and liability for violations during pre-trip medical examinations

Penalties for lack of a medical examination are established by Article 12.31.1. Code of Administrative Offenses of the Russian Federation:

For drivers: 3,000 rubles

For officials: 5,000 rubles

For legal entities: 30,000 rubles

Fines for violating the established procedure for medical examinations are prescribed in Article 11.32 of the Code of Administrative Offenses of the Russian Federation:

For drivers: 1,000 - 1,500 rubles

For officials: 2,000 - 3,000 rubles

For legal entities: 30,000 - 50,000 rubles

If the company fails to conduct an inspection or violates the procedure for conducting it, and the driver gets into an accident with serious consequences, it may lead to criminal prosecution. This is regarded as a violation of labor protection requirements (Criminal Code of the Russian Federation, Article 143). In this case, the manager and the person responsible for conducting inspections may be assigned:

A fine of up to 400,000 rubles or in the amount of wages or other income for a period of up to 18 months.

Compulsory work for a period of 180 to 240 hours.

Correctional labor for up to 2 years.

Forced labor for up to 1 year or imprisonment for the same period with deprivation of the right to hold certain positions or engage in certain activities.

It is impossible to collect a fine from an employee for failing to undergo a medical examination - this decision was made by the Sverdlovsk Regional Court on November 27, 2019 in the case of recovery of damages from an employee No. 33-20128/2019.

Document structure

The person responsible for conducting pre-trip inspections must record all inspection results in a special journal:

  1. This ledger is a book whose pages are numbered and bound.
  2. The last sheet should indicate the number of numbered sheets, indicate the date, put the signature of the manager and the seal of the organization. The full name of the person responsible for filling out the journal is indicated.

Storage periods and rules

Each business entity that maintains a log of pre-trip inspection of drivers must ensure secure and correct storage of closed accounting registers.

In accordance with the regulations of Federal legislation, commercial organizations and individual entrepreneurs are required to store logs for 5 years. Only after this period has expired can they destroy the accounting registers.

Post-trip medical examination: is it necessary to undergo it?

Post-trip inspections are only required for drivers who transport passengers or dangerous goods during working hours. The requirements for them are more stringent: they are checked after each shift and flight.

The procedure for post-trip medical examinations is the same as for pre-trip ones. These inspections have two purposes:

  1. Monitor employee health. Regular examinations help to notice in time the onset of an occupational disease or poisoning, and to track the impact of harmful factors on health.
  2. Identify employees who use alcohol or psychoactive substances at work.

For other drivers, inspections are only recommended. For example, it is recommended to examine people at risk after a flight: the elderly, people with illnesses, and people who drink alcohol.
