Pre-trip medical examinations
Who should be appointed as the person responsible for conducting pre-trip medical examinations in the organization - the head of the transport department or a labor protection specialist?
In your case, you need to appoint the head of the transport department responsible for conducting pre-trip medical examinations.
Organizing mandatory medical examinations is the responsibility of the employer represented by the head of the company (paragraph 7, paragraph 1, article 20 of the Federal Law of December 10, 1995 No. 196-FZ).
If the enterprise has a transport department, then its manager is appointed as the person responsible for pre-trip medical examinations. To do this, the employer issues an order appointing a person responsible for organizing and conducting pre-departure medical examinations of employees.
Occupational safety service specialists participate in the work to determine the contingent of workers subject to pre-trip (pre-shift) examinations (ETKS, approved by order of the Ministry of Health and Social Development of Russia dated May 17, 2012 No. 559n).

There are several ways to make changes to the labor protection instructions.
You can draw up a change sheet with the contents of the changes (additions, corrections, exclusions, etc.), agree on it with the trade union and attach it to the order to amend the instructions.
You can re-issue the instructions after going through the entire approval procedure and approve it in a new edition, and remove the previous edition of the instructions. This option is usually used once every five years during a planned review of occupational safety instructions.
Also, labor protection instructions for workers can be revised ahead of schedule (clause 7 of the Methodological Recommendations for the development of labor protection instructions, approved by the Russian Ministry of Labor on May 13, 2004):
- when revising intersectoral and sectoral rules and standard instructions on labor protection;

- when introducing new equipment and technology;
- based on the results of the analysis of materials from the investigation of accidents, industrial accidents and occupational diseases;

How to organize medical examinations for drivers
Medical examinations must be carried out in a medical office specially equipped and equipped for this purpose. The requirements for it are established by the Methodological Recommendations on the organization of pre-trip medical examinations of vehicle drivers (given in the letter of the Ministry of Health of Russia dated August 21, 2003 No. 2510/9468-03-32, hereinafter referred to as the Methodological Recommendations).
The driver must appear for inspection with a travel document issued for the current day. If during the examination the doctor does not identify any contraindications for allowing the driver to work, then at the end of the examination he will put a corresponding stamp on the waybill. It is this mark that will be the only evidence of passing a medical examination if the driver is stopped for an appropriate check by traffic police officers. The stamp must indicate the date and exact time of the medical examination, the surname, initials and signature of the medical worker who conducted the examination (clause 16 of the Mandatory details and the procedure for filling out waybills (approved by order of the Ministry of Transport of Russia dated September 18, 2008 No. 152)).
The inspection begins with a driver interview. The doctor finds out his subjective well-being, the presence or absence of complaints about his health. He is also obliged to carefully examine the condition of the driver’s skin, paying attention to the presence of scratches, abrasions, injection marks, pallor or redness of the skin. Of particular importance during examination is the condition of the pupils (constricted or dilated) and their reaction to light as an indicator of possible intoxication. Blood pressure and heart rate are measured in any case, body temperature - if there are objective indications.
If signs of intoxication are detected, then a sobriety control protocol of the established form must be drawn up (Appendix 3 to the Methodological Recommendations) in two copies. One copy remains with the health worker, the second is given to the head of the organization in which the driver works.
A general approximate list of cases for removal is given in the already mentioned letter of the Ministry of Health of Russia dated August 21, 2003 No. 2510/9468-03-32 “On pre-trip medical examinations of vehicle drivers.”
In addition, clause 12 of the Basic Provisions for the admission of vehicles to operation and the responsibilities of officials to ensure road safety (approved by Decree of the Government of the Russian Federation dated October 23, 1993 No. 1090) establishes a ban on the admission to drive vehicles of drivers who are intoxicated (alcohol, drugs or other), under the influence of medications that impair reaction and attention, in a painful or tired state that jeopardizes traffic safety.
Occupational safety instructions for a consulting company
Our company provides legal and accounting services. Do we need to have safety instructions for workers?
Yes need.
Labor protection instructions must be for every position that is in the organization’s staffing table. Employer
is obliged to develop and approve rules and instructions on labor protection for workers, taking into account the opinion of the trade union (Part 22, Article 212 of the Labor Code of the Russian Federation).
Samples of instructions on labor protection are available in the Methodological Recommendations for the Development of Instructions on Labor Safety (approved by the Ministry of Labor of Russia on May 13, 2004).
Storing labor safety instructions
Where in the organization should labor safety instructions be stored for employees?
Current labor protection instructions for workers, as well as their list, must be kept by the head of the department. The specialist himself determines the location of the instructions, taking into account accessibility and the opportunity to familiarize himself with them:
- issues instructions to employees to study during initial training;
- hangs at workplaces or areas;
- stored in another place accessible to employees.
(Methodological recommendations for the development of instructions on labor protection, approved by the Ministry of Labor of Russia on May 13, 2004).
Organization of pre-trip inspection
As for the organization of the inspection and who is inspecting drivers, there may be two options:
- Organization of a first aid station at the enterprise.
- Examination at the clinic by agreement.
Each method is characterized by its own individual characteristics and advantages. The choice of one option or another depends on the nature of the company’s activities and the number of drivers on staff.
Examination at a medical institution under contract
To receive services from a medical organization, you will need to enter into an official agreement with the selected clinic. After concluding an official contract, drivers can come to the clinic and, at a pre-agreed time, undergo a check without queue in the rooms indicated in the contract.
An agreement can only be concluded with an organization or medical staff who have a special license.
Examination in an equipped medical center at the enterprise
In addition to concluding an agreement with a certain medical organization, individual entrepreneurs and legal entities can hire a licensed medical officer and organize a pre-trip examination of drivers directly on the territory of the enterprise.
Along with the requirements for doctors, there are certain requirements for an equipped medical unit or examination room. The room for organizing the examination must be equipped with special devices, medical equipment and furniture. Among the most necessary are:
- medical couch;
- desk, lamp, chair, wardrobe, safe and floor covering;
- device for checking blood pressure levels;
- a device for detecting alcohol vapors in exhaled air;
- special express tests for the presence of drugs in the blood and alcohol;
- table for modern medical equipment;
- medical spatulas;
- a bag with a set of medications necessary for providing medical care.

At the same time, the room for taking standard biological samples must be very carefully prepared.
Drivers subject to pre-trip inspection
The law establishes an important rule, which states that all legal entities, without exception, as well as individual entrepreneurs who have drivers on their staff or are drivers themselves, are obliged to organize a pre-trip medical examination of each employee or undergo it themselves. The main objectives of the inspection include:
- Detection of alcohol or drug intoxication;
- Presence of psychotropic drugs in the blood;
- Identification of health problems: increased blood pressure or exacerbation of chronic diseases.
If such problems are detected, the driver is automatically suspended from work, as this is the basis for the formation of emergency situations. Such inspections are carried out throughout the period that employees perform driving-related duties.
The driver is examined before the start of the work shift. Employees over 55 years of age are required to undergo an examination upon completion of work.
